The application process for the U.S. EB-3 immigration visa is relatively simple compared to other immigration categories. It is known for its low threshold and minimal requirements. Below are the two types of application processes for those inside and outside the U.S.:

The Priority Date in the EB-3 employment-based immigration program is the key date that determines when an applicant can begin the final stage of the green card process (i.e., I-485 adjustment of status or consular interview). The starting point for this date is as follows:

About the EB-3 Priority Date

Specific Application Path (EB-3 Process)

In 2022, Ms. L took her then 12-year-old son to study in Canada. She was an ordinary office clerk in China with almost zero English foundation. However, to provide her child with a better educational environment, she quit her job, left her husband, and went alone to Vancouver as an accompanying parent.

For two years, she accompanied her child to school, rented apartments, and managed daily life, struggling almost daily in a language-barrier environment. During this time, she tried pathways like investment immigration and employer sponsorship to stay in Canada but was rejected due to insufficient language scores and lack of local work experience.

Considering her son's future education, Ms. L decided to end this journey of uncertainty and seek a stable U.S. immigration status. Upon the advice of [Star Ring Immigration], Ms. L chose the EB-3 Unskilled Worker visa. After careful preparation, she successfully entered the priority date waiting period, securing her immigration pathway:

1. Accompanying Parent from Canada (Outside the U.S.)

In 2018, Mr. W graduated from a prestigious university in California, majoring in Mechanical Engineering. Like most international students, he obtained a 12-month OPT (Optional Practical Training) after graduation and quickly found an engineering job in the Bay Area.

But bad news soon followed: he didn't get selected in the H1B lottery in his first year, nor in his second year. His OPT was about to expire, and his legal status was at risk. In this state of panic, he contacted [Star Ring Immigration]. After assessing his situation, the consultant recommended the EB-3 Skilled Worker path.

Initially, he hesitated: 'Why should a graduate from a top university take a lower-skilled immigration path?' However, facing the dual pressures of losing his work authorization and potential immigration failure, he eventually understood the high difficulty of U.S. immigration. It took him 5.5 years to go from an H1B lottery loser to a U.S. green card holder, without a single 'status gap' during the process.

Meanwhile, Mr. W's college friend, Mr. Z, graduated the same year and also failed his first H1B lottery. To stay in the U.S., he pursued a Master's degree, securing a two-year F-1 student visa. After graduating, he succeeded in the H1B lottery on his second attempt. Things seemed to be improving, but then disaster struck:

In late 2023, the startup company where Mr. Z worked suddenly faced a funding crisis and conducted massive layoffs.

After losing his job, he entered the 60-day grace period. However, as his new employer failed to successfully file an H1B transfer petition in time, he was forced to buy a plane ticket and leave the U.S. on the 59th day.

What once seemed like 'winning the lottery equals stability' ultimately lost to the harsh reality of 'employer risk'.

2. U.S. International Graduate

Ms. S is a business owner from Shanghai, China. In 2017, her son was 11 years old, and the family was planning for him to attend middle and high school in the U.S. Like many Chinese parents, her initial plan was: first send the child to study, then secure family status via EB-5 investment immigration so her child could attend public university at 'in-state' tuition rates.

But a problem arose: while the EB-5 threshold had lowered, proving the legitimate source of funds was operationally challenging.

Ms. S had accumulated significant capital during her early entrepreneurial years, making it difficult to fully document the source details. Multiple bank reviews, requests for additional documents, and frozen records left her feeling 'anxious and stuck'. Ms. S said she had done a financial assessment during the initial study abroad planning. Undergraduate studies in the U.S. are extremely expensive, but after successfully immigrating via EB-3, costs decreased significantly, and they could legally enjoy numerous U.S. benefits.

Ultimately, her child received offers from multiple prestigious U.S. universities, including a $15,000 scholarship. After settling with her family in the university's city, they qualified for in-state tuition discounts. On university tuition alone, Ms. S's family saved over $200,000 (approximately ¥1.45 million RMB).

3. Parent from China

In 2016, Ms. H quit her job at a foreign trade company in China to accompany her then 8-year-old daughter to study elementary school in the U.S. As a parent on a dependent visa (B2 typically), she had no work permit, couldn't legally work, and couldn't participate in mainstream society. Her daily routine involved picking up/dropping off her child, cooking, and grocery shopping. Gradually, she became an 'invisible person' in her social circle: unable to work, without income, without legal status.

Ms. H certainly wanted to 'stay'. But reality was harsh: she wasn't a STEM professional, so H1B wasn't an option; her language skills were insufficient to pass TOEFL/IELTS; she lacked the funds for EB-5; and at over 40 years old, juggling childcare and studies felt overwhelming.
